THE TIME IS NOW TO STOP THE USE OF MERCURY IN THE U.S. AND TO SEEK RESTITUTION FOR THOSE WHO HAVE BEEN SO ADVERSELY AFFECTED BY IT........
By bringing those with common issues together, we can effectively and efficiently organize and put together those who need help and are seeking restitution with those who are able and willing to provide it!!
Wayne Obie, Media & Public Relations- Talk International
Please read the following:
The dangers associated with mercury are so transparently obvious, especially to those who are most adversely affected by it.
Yet why has it not been banned?
The short answer to this question is "massive liabilities". The use of mercury in medicines and tooth restorations will be defended to the very end, even though there is substantial evidence proving it's adverse effects.
However, the tides are changing. It is only a matter of time before mercury is completely banned for use in dentistry and medicine. The question is will you be compensated for your pain and suffering or will mercury just quietly be phased out of use. Unlike tobacco, the group that knows they have been adversly affected by mercury is relatively small. This is evidenced by the fact that an on-line peition to have mercury banned in dentistry that ran for six months, has just over 3100 signatures, even though it received international support.
To be successful in creating successful legal actions relative to the use of mercury in the U.S., requires everyone affected to be working together. It requires national media and organized system for funding and bringing these cases to the lawyers to change make this possibility a reality.
Talk International, formed CFMR in 1996 to initiate the Class Action Mercury Amalgam Lawsuit in Canada. Although we have worked with many people and groups around the world over these years on the mercury dental amalgam issue, it was late last year, after being requested for some time to become involved in the U.S., that we determined that it was essential in order to be successful in the U.S. to bring everyone with together.
The poisoning associated with mercury use is not limited to dental restorations. Mercury is in the food we eat, the air we breathe, our water, and our vaccines and medicines. It was for this reason that when developing a strategy for the U.S., that "Americans against Mercury" was established. It is only by working together against "mercury - the common enemy", that we hope to gain the support necessary to ensure success.
Talk International is actively involved in working with lawyers and victims of mercury poisoning in the U.S. It is our goal to raise public awareness regarding the dangers of mercury and to create mainstream momentum against the use of mercury so that our environment and those who's health have been so adversly affected, by the most non-radioactive toxic substance known to man, are able to take steps to reverse some of the damage that has been done.
On April 24, we hosted a News Conference at which time the first of a series of massive legal actions were announced. These and future lawsuits will be posted to our website, as they are filed.
Since the News Conference, we have receieved hundreds e-mails and telephone inquiries from persons wishing to participate in legal actions related to mercury. We have also fielded a number of inquiries from attorneys now interested in learning more about the mercury issue and becoming involved in specific areas.
However, handling all of the inquiries can be overwhelming to say the least. U.S. attoneys are requesting information and resources to enable them to determine what might be winnable cases, but do not in most cases have the resources to enable them to be bombarded with inquiries from the public. The public wants to tell us their case histories and emphasize to us the reasons they want to sue and obtain restitution.
It is in answer to dealing with these situations that we have implemented this Legal Registry.
The registry consists of actions that are proposed as well as those which have already been initiated. In some instances we have requests from lawyers to identify specific classes and in other situations, we have listed what has been determined to be possible causes of action and issues of commonality which may qualify as a class.
Registration fees on the legal registry vary and are determined by a number of factors including, the estimated size of the grouping, current membership in the grouping, the rate at which membership is growing, whether or not lawyers are yet committed to proceeding with a specific action, how involved we will be in working with lawyers and other experts, and the estimated amount of time and expenses we expect to incur servicing the various needs.
The Legal Registry provides us with the ability to catagorize issues of commonality and to determine levels of participation, support and estimates of damage, for legal actions and potential actions which have an opportunity for success. By pre-organizing this information, we are also able to eliminate some of the fear experienced by attorneys, relating to the sheer size of the undertaking, while at the same time provide valuable information to enable law firms to work together with the various classes, minimizing their risks and initial investments, while enhancing your opportunity for success.

Charlie Brown, Esq., Counsel for Consumers for Dental Choice
Re: The Battle over the California Dental Materials Fact Sheet
In San Diego in May, the Board wisely rejected an abysmal proposed Fact
Sheet,
sending it back for re-writing.
Now more than ever we need your help, in two ways:
1. Come to L.A. to that meeting.
At a meeting earlier this month in San Diego, the presence and testimony of
mercury-free Drs. Dave Kennedy, Roberto Villafona, George Schuchard, and
OReilly was extremely helpful. We need to show the scientific support for
this cause.
2. Now - - please WRITE LETTERS!
Write these 4 people: the Governor, the Dental Board president, the state
Attorney General, and a key state Senator. Talking points and addresses are
below. Be upbeat & positive. We dont need to be critical of any of them
they all did the right thing last week!
Its time to go beyond informed consent. We need to establish a beachhead
a protected group of people who should not get amalgam. That would be the
Health Canada categories: children, pregnant women, people with kidney
problems and braces.
I have submitted a five-part proposal to the Dental Board for the Fact
Sheet:
* Recommend against mercury amalgam use for children, pregnant women, people
with kidney problems and braces. [Remember: always say mercury amalgam,
not amalgam].
* Before placing mercury amalgam the first time in a person due to the
fact that a certain percentage have allergies and genetic predispositions
dentists must take special precautions.
* For all users, warn that mercury is a reproductive toxin under California
law.
* Stop using the word silver.
* Explain that amalgam use is controversial, that viewpoints differ on its
safety, and that the mercury in the amalgam has environmental consequences
TALKING POINTS FOR LETTERS
To Governor Gray Davis, State House, Sacramento, CA: -- Fax: 916.445-4633
* Thank you for the timely action by the Department of Consumer Affairs that
led the Dental Board to reject a report covering up the dangers of mercury
amalgam.
* Mercury amalgam fillings are dangerous and controversial. In particular,
they can harm the brains of young and unborn children. They are dangerous
for those with kidney problems, braces, or genetic compositions that make
them particularly vulnerable to mercury.
* A 1992 law is still not being complied with the requirement of a Dental
Materials Fact Sheet on the risks of dental materials, to be written by the
California Dental Board.
* The Dental Board has a special meeting in June. Please ask the Board (1)
to protect pregnant women and children from mercurys dangers, (2) to
require that dentists tell the truth about the dangers of mercury, and (3)
to order that the deceptive word silver no longer be used to describe
mercury fillings.
To Dr. Kit Neacy, President, Calif. Dental Board, Sacramento, fax:
916.263-2140
* Thank you for rejecting a dental materials fact sheet that covers up the
dangers of mercury amalgam.
* At your June meeting, we urge you to stand up to the CDA, who continues to
want this issue hidden from public view.
*Consumers need a fact sheet that will (1) protect pregnant women and
children from mercurys dangers, (2) require that dentists tell the truth
about the dangers of mercury, and (3) order an end to the word silver to
describe mercury fillings
To Attorney General Bill Lockyer, State House, Sacramento. Fax 916.323-5340
* Thank you for standing up for consumers At a recent meeting of the Calif
Dental Board, your assistant informed the Board that dentists must tell
patients about the mercury in dental fillings, due to Proposition 65.
* For many years, the ADA and CDA hid the dangers of mercury amalgam by
calling it silver. This deceived and confused most people. They had no
idea that mercury (not silver) is the main ingredient in amalgam. Now you
have opined that, under Prop 65, dentists must use the m word, and say
that amalgam is mainly mercury. Congratulations.
To Senator Liz Figueroa, California State Senate, Sacramento, fax:
916.324-0917
* Thank you for insisting that the Dental Board write a Fact Sheet that
explains the risks of mercury amalgam in plain language.
* Fortunately, the Board rejected a fact sheet that covers up the risks of
mercury.
* The Board needs to stand up to the special interests and make sure the
Fact Sheet tells the truth about mercurys dangers. Consumers need a fact
sheet that will (1) protect pregnant women and children from mercurys
dangers, (2) require that dentists tell the truth about the dangers of
mercury, and (3) order that the deceptive word silver no longer be used to
describe mercury fillings.
Here is Charlie's original message sent on May 29, 2001:
Subj: June 14 --Flag Day -- in L. A.!
Date: 5/29/01 5:27:02 AM Pacific Daylight Time
From: brownchas@erols.com (Charles Brown)
A source at the Calif Dental Board says the Board's special meeting to vote
on the dental materials Fact Sheet will be THURS., JUNE 14, in LOS ANGELES.
We need a big crowd there, please.
Anita Tibua (949.650-4532) may have an empty house in which, if you bring
your sleeping bag, you can crash on June 13.
I don't know either the time or the place within L.A. yet.(Check this message
at the top for the correct time and place) But you can mark that on your
calendar.
We need dentists and consumers there. We need home made signs. We need to
show that a mass of Californians & Americans want mercury out of dentistry.
